Utility and Service Payment Responsibilities Tenant is responsible for payment of Trash, Water, Electricity, Pest Control, Internet, and Renter's Insurance; trash is a fixed monthly charge paid by Owner and reimbursed by Tenant at ($25) monthly; Water is flat fee of 100 $ paid by ownerand reimbursed by Tenant at monthly and Tenant will maintain backyard landscaping, replace the HVAC filter every (3) months, and arrange/pay pest control services directly. Landlord Responsibilities Landlord will pay all HOA dues and all City and/or County real property taxes and will maintain the front yard landscaping; Owner will provide Tenant with two sets of house keys and any applicable gate/garage remotes provided to Owner (to the extent such devices exist for the property), and Landlord will comply with Texas security-device and rekeying requirements as applicable. Lease Transfer, Break Policy, and Renewals Assignment, subletting, or any other transfer of this Lease is prohibited without Landlord's prior written consent; Tenant may not terminate this Lease early and remains responsible for rent and all obligations through the end of the Lease Term, except where early termination is expressly permitted by applicable Texas law (including Texas Property Code 92.016/92.0161 and 92.017); Landlord will mitigate damages as required by Texas Property Code 91.006, and any attempted waiver of that duty is void. Rent Payment, Late Fee, and Entry Monthly rent is due on the 1st of each calendar month; any late fee must be stated in the written lease, must be reasonable, and may not be charged unless rent remains unpaid for two full days after the due date (and reasonableness is presumed if within the statutory percentage caps in Texas Property Code 92.019); Landlord may enter the premises at reasonable times for inspection, repairs, and emergencies, with notice when reasonably practicable and except in emergencies.
