Lease Term This Lease Agreement ("Lease") shall commence for a fixed term of twelve (12) months. Any holdover tenancy requires the Landlord's prior written consent and shall be subject to the Holdover / Late Move-Out provisions of this Lease and applicable Florida law. 2. Rent Monthly rent is payable on the 1st day of each billing cycle, beginning on the moving date. Rent shall be paid electrically by Zelle, ACH, or wire transfer. If rent is not received within five (5) calendar days after the due date, a late fee of $100.00 will be assessed, as permitted by Florida law. Partial payments are not accepted unless expressly approved in writing by the Landlord. 3. Security Deposit Tenant shall pay a security deposit equal to one month's rent prior to moving in. Within 30 days after Tenant vacates the premises, the Landlord will provide written notice of any intent to impose a claim against the security deposit. The deposit may be applied toward unpaid rent, damages beyond ordinary wear and tear, or other lawful charges. 4. Utilities Internet service is included in the base rent. Electricity and water are billed quarterly and allocated among tenants based on the number of tenants within the Property. Utility charges remain the Tenant's responsibility and may not be automatically deducted from the security deposit except as permitted by Florida law and with proper notice after moving out. 5. Occupancy Only the named Tenant(s) may occupy the assigned room. Subletting, assignment, or room sharing is strictly prohibited without prior written consent of the Landlord. Guests staying more than three (3) consecutive days require advance written approval from the Landlord. 6. Rules and Restrictions Tenant agrees to comply with all house rules, HOA rules, and applicable laws, including but not limited to the following: No smoking inside the Property. No conduct causing disturbance, nuisance, or unsafe conditions. Compliance with all HOA rules is mandatory; violation constitutes a material breach of this Lease. 7. Maintenance and Tenant Responsibilities Tenant shall maintain the assigned room in a clean and sanitary condition and promptly notify the Landlord of any maintenance concerns. The Landlord is responsible for major systems, including HVAC, plumbing, and electrical systems. Tenant is responsible for damage caused by negligence, misuse, or intentional acts. Tenant shall not make repairs, alterations, or modifications without prior written consent. Tenant is responsible for damage caused by tenant and each repair cost at $150.00 or below. House Maintenance Guidelines: Do not dispose of paper or non-flushable items in toilets. Use provided trash receptacles. Do not pour boiling water into the kitchen sink, as it can damage the plastic drainpipes Minor clogs should be addressed using a plunger or drain opening solution. Tenant is responsible for clogs caused by misuse. Trash bins (black bin) must be placed curbside every Tuesday and Friday morning (6:00 7:00 AM) or the evening prior. Tenant shall use cleaning tools to maintain floors and common areas. Open flames or fires of any kind are prohibited inside the Property. If water leakage, flooding, or damage is observed, Tenant must notify the Landlord immediately. Intentional or severe damage caused by Tenant may constitute grounds for termination in accordance with Florida law. 8. Landlord Access and Shared Occupancy Tenant acknowledges that the Property is a shared residence. The Landlord may occupy other rooms and may enter common areas at any time. Except in emergencies, the Landlord shall provide reasonable advance notice prior to entering the Tenant's assigned room, in compliance with Florida Statutes 83.53. 9. Liability and Insurance Tenant is responsible for their own actions and those of their guests. The Landlord shall not be liable for loss or damage to Tenant's personal property. Tenant is strongly encouraged to maintain renter's insurance for personal property and liability protection (for example, Geico/Homesite Insurance). 10. Early Termination Unauthorized early termination may result in liability for unpaid rent and damages as permitted by Florida law. Holdover / Late Move-Out: If Tenant fails to vacate the assigned room and returns all keys by 12:00 PM (noon) on the lease end date, Tenant shall be deemed a holdover occupant. During any holdover period, Tenant agrees to pay: (a) daily rent equal to 1/30 of the monthly rent, plus (b) a holdover surcharge of $100.00 per day, representing reasonable and foreseeable damages due to scheduled occupancy by another tenant, administrative costs, and disruption of leasing arrangements. This charge does not waive the Landlord's right to pursue eviction, recover possession, or seek additional damages as permitted under Florida law. Landlord may terminate the Lease with 30 days' written notice for lawful reasons, including but not limited to substantial repairs, personal occupancy, or material lease violations. 11. HOA Approval and Conditional Occupancy Tenant agrees to timely submit all documents, fees, and information required by the HOA. Occupancy is contingent upon HOA approval. The Landlord is not responsible for HOA decisions or Tenant's failure to comply. 12. Dispute Resolution In the event of a dispute, the parties agree to first attempt good faith negotiation. If unresolved, either party may pursue legal remedies available under Florida law. This section does not waive any non-waivable statutory rights. 13. Governing Law This Lease shall be governed by and construed in accordance with the laws of the State of Florida. Addendum A House Rules (Part of Lease) The following House Rules are incorporated into and made part of this Lease. Violation of these rules constitutes a material breach. Quiet Hours: 10:00 PM 7:00 AM daily. Excessive noise, loud music, or disruptive behavior is prohibited. Common Areas: Kitchen, living room, laundry, and other common areas are shared spaces and must be kept clean after each use. Kitchen Use: Label personal food items. Do not use or remove others' food without permission. Laundry: Use only during reasonable hours. Remove items promptly after cycles are complete. Parking: Parking is permitted only in designated areas (in the front of property and the West side of townhouse building) as directed by the Landlord or HOA. Pets: No pets are allowed unless expressly approved in writing by the Landlord and HOA. Illegal Activity: Any illegal activity on the Property is strictly prohibited and grounds for immediate lease termination as allowed by law. Safety & Security: Do not disable smoke detectors, locks, or security devices. Required at Move-Out: Room and common areas must be broom-clean, trash removed, refrigerator and bathroom cleaned, all personal items removed, and all keys, remotes, and access devices returned. Failure to return keys or devices may result in lock replacement charges. Addendum B Incoming Tenant Dependency Tenant acknowledges that the lease end date is scheduled based on a confirmed or anticipated incoming tenant. Any failure to vacate on time may cause direct financial loss to the Landlord, including lost rent, concessions, or penalties owed to the incoming tenant. Tenant agrees that the holdover rent and surcharge stated in this Lease are reasonable estimates of such damage and not a penalty.
