TERMS AND CONDITIONS Lease Term: The rental term commences on May 1, 2026, and terminates at 12:00 PM on April 30, 2027. Rental Payments: The Tenant agrees to pay a monthly rent of $1,300, with the first payment due on May 1, 2026, and subsequent payments due on the 1st day of each calendar month in advance. Rent payments received after the 4th day of the month will incur a $40 late fee. Rent shall be paid at 5144 NE 6th Court, Des Moines, IA 50313, or such location as the Landlord may designate in writing. Security Deposit: Upon execution of this agreement, Tenant shall provide a refundable security deposit in the amount of $1,300, held in compliance with the Iowa Uniform Residential Landlord and Tenant Act. The Landlord may schedule a property inspection 45 days prior to move-out to determine if any repairs are needed. Should no repairs be required, the security deposit may be applied to the final month's rent. Use of Premises: The Tenant shall occupy the dwelling unit exclusively as a residential dwelling. Written approval from the Landlord is required for any other use. Utilities and Services: Tenants are responsible for utilities as indicated below: Utilities must be transferred into the Tenant's name prior to occupancy. Failure to transfer utilities within 3 days of occupancy will result in disconnection. Tenants shall use utilities in a reasonable manner, and modifications that materially increase energy consumption require prior written approval. Tenant's Responsibility: Electricity, gas, water/sewer, heat, internet, TV, and snow removal. Landlord's Responsibility: Garbage/recycling and lawn care. Landlord's Maintenance Obligations: The Landlord shall: Maintain the dwelling unit in compliance with applicable health and safety codes. Ensure repairs are completed to maintain the property in habitable condition. Maintain all electrical, plumbing, heating, and other appliances provided by the Landlord in good working order. Keep common areas safe and clean. Tenant's Maintenance Obligations: The Tenant shall: Alterations, repairs, or maintenance performed by the Tenant require a separate, written agreement. Keep the premises clean and safe. Dispose of waste in a proper manner. Keep plumbing fixtures clean and in working condition. We are on septic. So there should be nothing going down the pipes other than bathroom waste, toilet paper (must be septic safe), water waste. No food or items should be sent through plumbing. If this is found while doing maintenance, Tenant may be held responsible for damages. Avoid damage to the property and appliances. Respect neighbors by avoiding disturbances. Parking & Storage: Tenants shall utilize the designated parking area (concrete slab only, no grass parking) located at 5142 NE 6th Court. The shed located on the property is for Landlord use only and must remain accessible at all times. Failure to comply with this provision may result in early termination of the lease. Rules and Regulations: All existing and future rules governing the Tenant's use of the premises shall be issued in writing by the Landlord. These rules constitute part of this agreement. Access to Premises: The Landlord, with prior notice and reasonable consent from the Tenant (which shall not be unreasonably withheld), may enter the premises to inspect, perform repairs, or show the unit to prospective buyers or tenants. Landlord may also access the unit without prior notice in cases of emergency or when impracticable to obtain prior consent. Assignment and Subletting: The Tenant may not assign or sublet the dwelling unit without prior written consent from the Landlord. The Landlord reserves the right to assign their interest in this lease in the event of property sale or renovations, with 30 days' written notice provided to the Tenant. Condition of Property & Acceptance: The Tenant agrees the dwelling unit is in a habitable, clean, and safe condition upon occupancy. Any defects or issues must be reported within 72 hours of move-in; failure to do so will indicate acceptance of the property's condition as-is. Casualty Damage: In the event of a fire or other casualty rendering the dwelling unit unfit for occupancy, the Tenant may: The Landlord will refund any applicable prepaid rents or security deposits in accordance with state law. Vacate immediately and terminate the agreement with 14 days' written notice, or Remain in the unaffected portions of the unit if lawful and agreeable, with rent adjusted proportionally. Nonpayment of Rent: The Landlord may issue a 3-day written notice to quit if rent is unpaid. If the Tenant fails to remedy unpaid rent within that timeframe, the Landlord reserves the right to terminate the agreement. Termination & Early Vacating: If the Tenant vacates the premises before the lease expires, the Landlord reserves the right to accelerate and collect all remaining rents due under the agreement. Notices: All notices required by this agreement shall be delivered in writing through one of the following methods: Personal delivery. Certified mail with return receipt requested. Service compliant with the law for original notices. Fixtures & Alterations: All fixtures, improvements, and alterations to the premises shall remain with the property upon lease termination. Structural changes require prior written approval from the Landlord. Entire Agreement: This agreement represents the full and final understanding between the Landlord and Tenant. No oral statements or previous representations supersede the terms outlined herein. Breach of Agreement: Providing false or misleading information material to the agreement shall constitute a breach and grounds for termination. Insurance & Indemnification: The Landlord and its insurer(s) retain all rights, including subrogation rights, to seek compensation for losses caused by the negligence or actions of the Tenant.
