1. Premises The Landlord leases to Tenant the residential dwelling located at 57 Union Street, Unit #1, Wolfeboro, NH 03894("Premises"), to be used solely as a private residence. Occupancy only. No additional occupants or animals are permitted without prior written consent of the Landlord. 2. Lease Term The lease term shall commence on February 5, 2026, and shall terminate on April 30, 2027, unless earlier terminated in accordance with this Agreement or New Hampshire law. 3. Rent Tenant agrees to pay rent in the amount of Two Thousand Dollars ($2,000.00) per month. Rent is due on or before the 1st day of each month Rent is considered late after the 4th day of the month A $25 late fee will apply Method of Payment Rent shall be paid electronically via check. Returned, rejected, or failed payments shall incur a $35 fee, and Landlord may require future payments by certified or guaranteed funds. 4. Lease Execution & Required Payments To proceed with this rental: Lease must be signed First month's rent ($2,000) due at signing Last month's rent ($2,000) due at signing Security deposit ($2,000) due prior to move in Failure to meet these requirements may result in termination of this rental offer. 5. Security Deposit (Not Rent) Tenant shall provide a security deposit equal to one month's rent ($2,000). The security deposit may not be used as last month's rent or to cover any rental payment. The security deposit shall be returned only after Tenant vacates the Premises, returns all keys, and completes a move-out walkthrough, and only in accordance with RSA 540-A. The deposit will be returned within 21 days, less any lawful deductions for unpaid rent, cleaning, damage, deodorization, repairs, or abandoned property. An itemized accounting will be provided. 6. Early Termination by Tenant Tenant may terminate this Lease prior to agreement, only under the following conditions: 1. 2. 3. Tenant must provide no less than ninety (90) days' written notice of intent to terminate. Tenant shall pay an early termination fee equal to two (2) full months' rent, which is separate from and in addition to all rent owed during the 90-day notice period. Tenant remains fully responsible for: o Rent during the entire 90-day notice period o Utilities and lease obligations through vacating o Surrender of possession and return of keys The early termination fee is not rent and does not replace or reduce rent owed during the notice period. Landlord will make reasonable efforts to re-rent the Premises. Any rent received from a replacement tenant during the same period shall be credited as required by New Hampshire law. Failure to comply constitutes a material breach. 7. Utilities & Heating Tenant shall be responsible for payment of all utilities serving the Premises, including water/sewer, electricity, and heating fuel. Water and sewer charges shall be paid monthly directly to the Town of Wolfeboro. Heating fuel service is currently provided through Eastern Propane and Oil. Tenant shall contact Eastern Propane and Oil prior to move in to get their name on the agreement and shall establish and maintain automatic fuel delivery for the duration of the lease term. Tenant shall be responsible for all charges associated with heating fuel from the date the account is transferred and shall ensure uninterrupted service at all times. Tenant must: Maintain a minimum temperature of 58 F Maintain automatic fuel delivery Use oil heat only Space heaters are prohibited 8. Renters Insurance (Required) Tenant must maintain renters insurance for the entire lease term. Policy must include: Minimum $300,000 personal liability Pet liability coverage included Landlord listed as Interested Party or Additional Interest Deductible of $1,000 or less Active prior to move-in and continuously maintained Failure to maintain insurance is a material breach. 9. Maintenance & Condition Tenant shall maintain the Premises in a clean and sanitary condition and promptly report needed repairs. Tenant is responsible for damage caused by misuse, negligence, or failure to maintain. 10. Damage to Premises; Pet Damage Tenant shall be fully responsible for any and all damage to the Premises caused by Tenant, guests, invitees, or pets, including but not limited to damage caused by the Tenant's cat. This includes, without limitation: Scratches, stains, odors, or damage to floors, walls, trim, doors, screens, or windows Damage caused by urine, scratching, chewing, or pet activity Damage caused by misuse or negligence Tenant shall reimburse Landlord for the full cost of repair, cleaning, deodorization, restoration, or replacement, including labor and materials. Costs may exceed the security deposit. Normal wear and tear excepted. 11. Professional Cleaning Requirement Upon move-out, Tenant shall leave the Premises professionally cleaned, including kitchens, bathrooms, floors, appliances, and removal of pet hair and odors. If Tenant fails to do so, Landlord may arrange professional cleaning and deduct the cost from the security deposit. 12. Condition Checklists A Move-In Condition Checklist shall be completed and signed at move-in. A Move-Out Condition Checklist may be completed at move-out and used to determine lawful deductions. 13. Repeated Late Payment If rent is late more than two (2) times in any twelve-month period, Landlord may require all future payments to be made by certified or guaranteed funds. 14. Inspections & Entry Landlord may conduct annual or semi-annual inspections with at least 24 hours' notice, during reasonable hours, or immediately in emergencies, in accordance with NH law. 15. Parking & Snow Removal One parking space provided No RVs, campers, or storage without written consent Snow removal is Tenant's responsibility 16. No Smoking / No Dogs / Use Restrictions No smoking No dogs No illegal activity No business use involving client visits No large gatherings Quiet hours: 10:30 PM 7:00 AM 17. Subletting Subletting or assignment without written consent is prohibited. 18. Legal Fees Prevailing party may recover reasonable attorney's fees and court costs as permitted by law. 19. Governing Law This Agreement is governed by the laws of the State of New Hampshire. 20. Entire Agreement This Agreement constitutes the entire agreement between the parties.
