QUIET HOURS. Quiet hours are from 2:00 a.m. to 8:00 a.m. During quiet hours, music, television, conversations, and other noise shall be kept at a reasonable volume so as not to disturb surrounding residents.
OCCUPANTS. The Premises shall be occupied by ___Tenant during the Lease Term.
Friends and family may visit the Premises, subject to the terms of this Agreement. No additional person may stay overnight at the Premises without the Host's prior written approval.
Unauthorized overnight occupants or occupancy exceeding the number permitted under this Agreement may constitute a violation of this Agreement, subject to applicable California law.
PAYMENT METHOD
Payments may be made by Zelle or Venmo using the payment information provided by Landlord.
Before sending the full payment by Zelle, Tenant is requested to send a $1.00 test payment. Once Landlord confirms receipt of the test payment, Tenant may send the remaining amount due.
Any payment not received when due shall constitute a default under this Agreement, subject to any notice, cure period, or other requirements provided by applicable California law.
If rent is not received when due, Landlord may serve any notice required by California law and pursue remedies available under this Agreement and applicable law.
Acceptance of a late payment shall not constitute a continuing waiver of Landlord's right to require timely payment of future amounts due, subject to applicable law.
CONDITION PRECEDENT TO OCCUPANCY
Tenant's right to take possession of the Premises is conditioned upon Landlord's receipt of all payments required to be paid prior to occupancy under this Agreement.
No partial payment shall, by itself, entitle Tenant to possession of the Premises. Landlord shall not be required to provide keys, access codes, or possession of the Premises until all amounts required prior to occupancy have been received, subject to applicable California law.
RENTER'S INSURANCE & PROPERTY DAMAGE
Tenants are required to maintain renter's insurance for the entire Lease Term, with a minimum of $100,000 in personal liability coverage. Proof of current coverage must be provided to Landlord or Property Manager prior to occupancy and upon reasonable request during the Lease Term.
Tenant understands that Landlord's insurance does not ensure Tenant's personal belongings or personal property and may not provide coverage for Tenant's personal liability.
Tenant is responsible, subject to applicable law, for damage to the Premises, furnishings, appliances, fixtures, equipment, or other property caused by Tenant, Tenant's occupants, guests, invitees, or approved pets, excluding ordinary wear and tear.
Tenant shall promptly notify Landlord or Property Manager of any damage, accident, water leak, fire, or other incident that may result in property damage or an insurance claim.
Renter's insurance does not relieve Tenant of financial responsibility for damage for which Tenant is legally responsible. Tenants remain responsible for lawful repair or replacement costs resulting from such damage, including amounts not covered by insurance, subject to the terms of this Agreement and applicable California law.
Tenant shall provide proof of the required renter's insurance prior to receiving possession of the Premises.
SECURITY DEPOSIT & CLEANING
1. Security Deposit
Upon execution of this Agreement, Tenant shall pay Landlord a Security Deposit of $1,850.00. The Security Deposit shall be held and administered in accordance with California Civil Code 1950.5 and may be used only for purposes permitted by California law.
The Security Deposit is refundable, less any lawful deductions permitted under California law.
2. Cleaning and Lawful Deductions
Tenant agrees to maintain the Premises in a clean, neat, and orderly condition throughout the tenancy and to return the Premises at the end of the tenancy in substantially the same level of cleanliness as at the commencement of the tenancy.
Landlord's customary professional departure/turnover cleaning cost is approximately $350.00. To the extent cleaning is reasonably necessary to return the Premises to the same level of cleanliness as at the commencement of the tenancy, the actual and reasonable cost of such cleaning may be deducted from the Security Deposit as permitted by California law.
If additional cleaning beyond the customary turnover cleaning is reasonably necessary due to the condition in which Tenant leaves the Premises, the actual and reasonable additional cleaning costs may also be deducted from the Security Deposit to the extent permitted by California law.
The Security Deposit may also be used for other lawful deductions, including unpaid rent and the repair of damage to the Premises caused by Tenant, Tenant's occupants, guests, or pets beyond ordinary wear and tear, as permitted by California law.
3. Return of Security Deposit and Itemized Accounting
Within twenty-one (21) calendar days after Tenant vacates and surrenders possession of the Premises, Landlord shall provide Tenant with the remaining balance of the Security Deposit, together with an itemized written statement identifying any deductions, in accordance with California Civil Code 1950.5.

CALIFORNIA-COMPLIANT PET ADDENDUM CLAUSE
1. Approved Pet(s): Tenant is permitted to keep only the following specifically approved pet(s) 5 lbs. and under at the Premises:

2. Refundable Pet Deposit: Tenant agrees to pay an additional refundable pet deposit of $300.00 prior to occupancy. This pet deposit shall be combined with the general security deposit and held by Landlord in accordance with California Civil Code 1950.5.
3. Application of Deposit & Deductions: The pet deposit is fully refundable upon move-out, provided no pet-related damage or cleaning issues exist. Landlord may deduct from the total security deposit for actual, reasonable costs incurred due to the pet, including but not limited to:
Repair of physical damage to the Premises (walls, doors, flooring, yard, etc.).
Professional cleaning, deodorization, or carpet treatment required to restore the Premises to its move-in condition.
Pest control or flea treatment required as a result of the pet.
4. Tenant Responsibilities:
Tenant shall keep the pet under reasonable control at all times and adhere to all local leash and noise ordinances.
Tenant shall promptly clean up and properly dispose of all pet waste inside and outside the Premises.
Tenant agrees that payment of the pet deposit does not limit Tenant's total liability. Tenant remains financially responsible for any pet-related damage or cleaning costs that exceed the total security deposit amount.
UTILITIES AND SERVICES
Landlord shall maintain the gas and electric utility accounts in Landlord's name and shall be responsible for a combined maximum allowance of $400.00 during the Lease Term.
Tenant Responsibility for Overages: Tenant shall be responsible for combined gas and electric charges exceeding the $400.00 allowance attributable to the Lease Term.
Documentation: If the combined charges exceed $400.00, Landlord shall provide Tenant with copies of the applicable utility statement(s) showing the charges and calculation of Tenant's share.
Payment: Tenant shall reimburse Landlord for any properly documented utility overage within 14 days after receiving written notice and copies of the applicable utility statement(s).
Conservation: Tenant agrees to use utilities reasonably and responsibly, including keeping exterior doors and windows closed while heating or air conditioning is operating, and shall promptly notify Landlord or Property Manager of known utility leaks, malfunctioning appliances, or thermostat problems.
Metering: Landlord represents that the gas and electric charges used to calculate Tenant's responsibility under this provision relate to utility service for the Premises and do not include charges attributable to another dwelling unit.
SMOKING POLICY
Smoking of any kind, including cigarettes, cigars, vapes, and marijuana, is strictly prohibited inside the house.
Smoking is permitted only in the backyard. Tenant and guests must smoke responsibly and be respectful of the property. All cigarettes, cigars, ashes, and other smoking-related materials must be properly and safely disposed of. Smoking materials may not be discarded on the ground, in landscaping, or anywhere else on the property.
VIOLATION: Any smoking inside the house, or failure to comply with the requirements for smoking in the backyard, shall constitute a violation of this Agreement and may result in the Landlord serving any notice permitted or required under California law, including, when applicable, a 3-Day Notice to Cure or Quit.
Tenant shall be responsible for all actual and reasonable cleaning, deodorizing, smoke remediation, or repair costs resulting from a violation of this policy. Any lawful charges may be deducted from the Security Deposit in accordance with California law, and Tenant remains responsible for lawful costs exceeding the Security Deposit.
SUBLETTING AND ASSIGNMENT
Tenant shall not sublet any portion of the Premises or assign this Agreement without Landlord's prior written consent.
USE OF PREMISES
The Premises shall be used solely for residential purposes by the Tenant and other occupants specifically authorized under this Agreement.
Tenant shall not conduct commercial activities from the Premises that materially increase traffic, create a nuisance, violate applicable law, or violate applicable restrictions governing the Premises.
LANDLORD'S RIGHT OF ENTRY
Landlord may enter the Premises only as permitted by California law, including for lawful purposes such as necessary or agreed-upon repairs, maintenance, inspections permitted by law, showing the Premises to prospective tenants, purchasers, lenders, or contractors, or in the event of an emergency.
Except where California law permits entry without advance notice, Landlord shall provide Tenant with the notice required by applicable California law.
MAINTENANCE AND REPAIRS
Tenant shall keep the Premises reasonably clean and sanitary and shall use the Premises, furnishings, appliances, fixtures, and equipment in a reasonable and lawful manner.
Tenant shall promptly notify Landlord or Property Manager of conditions requiring repair or maintenance, including water leaks or conditions that could result in additional property damage.
Tenant shall be responsible, to the extent permitted by California law, for damage to the Premises caused by Tenant, authorized occupants, guests, invitees, or approved pets, excluding ordinary wear and tear.
At the conclusion of the Lease Term, Tenant shall return the Premises in substantially the same condition and level of cleanliness as at the beginning of the tenancy, excluding ordinary wear and tear.
Any lawful amounts owed by Tenant for cleaning or damage may be deducted from the security deposit in accordance with California law.
QUIET ENJOYMENT AND CONDUCT
Tenant shall conduct themselves, and shall require Tenant's occupants, guests, and invitees to conduct themselves, in a manner that does not unreasonably disturb neighbors or interfere with the peaceful enjoyment of surrounding properties.
Tenant shall comply with the quiet-hours provisions and other reasonable rules contained in this Agreement.
Material violations of this provision shall be handled in accordance with this Agreement and applicable California law.
ILLEGAL ACTIVITY
Tenant shall not use or permit the Premises to be used for unlawful purposes.
A violation of this provision may constitute a breach of this Agreement and shall be addressed in accordance with applicable California law. Nothing in this provision authorizes Landlord to remove Tenant, change locks, terminate utilities, or otherwise recover possession except through procedures permitted by law.
Landlord retains all rights and remedies permitted under California law concerning unauthorized occupancy or holdover.
