1. Lease Term
This is a fixed-term lease of twelve (12) months. The Lease is for 12 months, unless earlier terminated in accordance with this Agreement or applicable California law. Any extension or renewal shall be in writing and signed by both Landlord and Tenant.
2. Monthly Rent
Tenant agrees to pay monthly rent in the amount of Two Thousand Nine Hundred Fifty Dollars ($2,750.00), due on the first (1st) day of each month without demand.
Tenant shall be granted a three (3) calendar day grace period. If rent is not received by the end of the third (3rd) calendar day following the due date, Tenant shall be in default of the rental payment provisions of this Lease.
3. Late Charge
If rent is not received within the three (3) day grace period, Tenant agrees to pay a late charge equal to five percent (5%) of the monthly rent, in addition to any other remedies available to Landlord under this Lease and applicable California law.
The assessment of a late charge shall not constitute a waiver of Landlord's right to pursue any other remedy available for Tenant's default.
4. Security Deposit
Upon execution of this Lease, Tenant shall pay:
* First Month's Rent: $2,750.00
* Security Deposit: $2,750.00
The security deposit may be applied toward unpaid rent, damages beyond ordinary wear and tear, cleaning costs, or any other deductions permitted by California law. Any remaining balance shall be returned in accordance with California law after Tenant vacates the Premises.
5. Condominium Association Rules
The Premises are located within a condominium community governed by a Homeowners Association ("HOA").
Tenant acknowledges receipt of, or access to, the HOA's CC&Rs, Rules and Regulations, Architectural Guidelines, and any amendments thereto, and agrees to comply with all such governing documents throughout the tenancy.
Any violation of the HOA governing documents by Tenant, Tenant's occupants, guests, invitees, contractors, or pets shall constitute a violation of this Lease.
Repeated or material violations of the HOA's governing documents shall constitute a material breach of this Lease.
6. Additional Rent HOA Charges
Any fines, penalties, assessments, repair costs, attorney's fees, administrative fees, or any other expenses incurred by Landlord or imposed by the HOA as a direct or indirect result of the acts, omissions, negligence, or violations of Tenant, Tenant's occupants, guests, invitees, contractors, or pets shall be the sole responsibility of Tenant.
All such amounts shall be deemed Additional Rent under this Lease and shall be due and payable with Tenant's next monthly rent payment, or within ten (10) days after written notice from Landlord, whichever occurs first.
Failure to timely pay any Additional Rent shall constitute a material breach of this Lease.
7. Use of Premises
The Premises shall be used solely as a private residence. No business activity, short-term rental, or unlawful activity shall be conducted on the Premises.
Only the individuals listed on this Lease may occupy the Premises unless otherwise approved in writing by Landlord.
8. Maintenance and Repairs
Tenant shall maintain the Premises in a clean, sanitary, and safe condition.
Tenant shall promptly notify Landlord of any water leaks, plumbing issues, electrical problems, appliance malfunctions, or any condition requiring repair.
Tenant shall be responsible for repairs resulting from Tenant's negligence, misuse, abuse, failure to report damage promptly, or the actions of Tenant's occupants or guests.
9. Utilities
Tenant shall be responsible for payment of all electricity, water, and gas services unless otherwise agreed to in writing by the parties.
10. Alterations
Tenant shall not paint, remodel, install fixtures, replace locks, mount televisions, install satellite dishes, or make any alterations or improvements without Landlord's prior written consent.
11. Pets
One pet shall be permitted unless specifically authorized in writing by Landlord.
Any approved pet shall remain subject to all HOA rules and applicable laws.
Tenant shall be responsible for any damages, nuisance, or HOA violations caused by an approved pet.
12. Parking
Tenant may use only the parking space(s) assigned to the Premises.
All vehicles shall remain currently registered, insured, operable, and maintained in accordance with HOA rules.
Guest parking shall be used only as permitted by the HOA.
13. Smoking
Smoking, vaping, or the use of tobacco, cannabis, or similar products is prohibited inside the Premises and in any area where prohibited by HOA rules or applicable law.
14. Right of Entry
Landlord may enter the Premises as permitted by California law for inspections, repairs, maintenance, emergencies, or to exhibit the Premises to prospective purchasers or tenants.
15. Renters Insurance
Tenant must maintain renters insurance throughout the tenancy with a minimum of $100,000 in personal liability coverage and shall provide proof of coverage upon Landlord's request.
16. Subleasing and Assignment
Tenant shall not assign this Lease or sublease any portion of the Premises without Landlord's prior written consent.
17. Default
Failure to pay rent or Additional Rent when due, repeated HOA violations, unauthorized occupants, unauthorized pets, unlawful conduct, or any material violation of this Lease shall constitute a default.
Upon default, Landlord may exercise all rights and remedies available under this Lease and California law.
18. Attorney's Fees
In any action arising out of this Lease, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs to the extent permitted by California law.
19. Governing Law
This Lease shall be governed by and interpreted in accordance with the laws of the State of California.
20. Entire Agreement
These Additional Terms and Conditions, together with the Residential Lease Agreement, all required California disclosures, and the HOA governing documents, constitute the entire agreement between the parties regarding the tenancy.
