Additional Provisions 38a.All tenants will complete and favorably pass a third-party background check ahead of lease signing and occupying the property. Additionally, the tenant(s) will purchase and hold renters' insurance for the entire rental agreement, including six (6) month renewals and month-to-month agreements, and will provide a copy to the landlord before occupying the rental property. All policies must have a minimum coverage of $100,000 Personal Liability and list the landlord as an "Interested Party". 38b.Privacy will be mutually respected between the landlord, tenant(s), and guests. 38c. The tenant(s) will only have access to the basement of the property, the main floor to move to/from either front or patio entrances to basement door, the outdoor patio and yard, and the garage for small storage only. The tenant may not use any other room or property of the landlord without permission. Tenants will not leave belongings in shared spaces other than what is necessary in the garage. Tenants and guests must use the front or back door of the property for the entrance and exit as there is no private entrance to the rental basement property, except for the fire escape which will only be used for emergencies. 38d. The rental property is for residential purposes only and unfurnished other than a refrigerator, microwave, sink, stove, range hood, dishwasher, washer/dryer, standing fan, and air purifier. 38e. If a rental agreement is started after the first (1st) of the month, the first month's rent and utilities will be prorated at the discretion of the landlord. 38f. The security deposit will cover any damage caused by a tenant's negligence, carelessness, or intentional abuse of the property. The security deposit will not incur interest not increase in value while held by the landlord. The security deposit cannot be used by the tenant as payment for rent or utilities. 38g. All utilities (electric, gas, water, waste, and internet) are shared between the landlord and tenants. All monthly utility statement will be shared with the tenants, will be split in half between the landlord and tenants, and paid in full to the landlord with the monthly rent payment. 38h. Access to the garage for small storage purposes may be available on designated storage shelves. No vehicles or motor equipment will be parked or stored in the garage. 38i. For the security of the tenants and landlord, smart home devices (doorbell with camera, thermostat, outdoor locks, kitchen camera, and patio camera) have been installed. No cameras or recording devices are present in the basement property. The tenant agrees to be recorded either by video and/or audio and that data be stored from only these devices upon signing this agreement. The landlord reserves the right to maintain sole access to all smart home devices. These devices will not be altered in any way by the tenant. 38j. The landlord reserves the right to enter the property for emergency repairs or events without notice. All other non-emergency activities or property inspections that are required to enter the rental property will be provided 24 hours' notice to the tenants, when possible. 38k. Tenants will provide 30 days written notice to the landlord before the end of the rental agreement if the tenants will vacate at the end of the agreement, renew the agreement for another six (6) months, or transition the agreement to month-to-month. If the tenant requests to transition the rental agreement to a month-to-month agreement, the rental agreement rules remain in place and monthly rent will rise from $1000 to $1400 per month effective the first (1st) day of the month after the rental agreement ends. If the tenant does not provide written notice to the landlord at least 30 days before the end of the rental agreement, the rental agreement rules remain in place, the agreement will become a month-to-month agreement, and monthly rent will change from $1000 to $1400 per month effective the first (1st) day of the month after the rental agreement ends. The landlord reserves the right to change the monthly rent amount after the rental agreement has ended or provided written notification sixty (60) days before the agreement is renewed or transitions to a month-to-month agreement that the monthly rent amount will change. The landlord reserves the right to not renew the rental agreement or allow a month-to-month agreement for any reason. 38l. When a tenant vacates, they will have all belongings removed and leave the rental property in as good condition as first occupied before the end of the rental property agreement. Any remaining belongings in the rental property beyond the end of the rental agreement will be deemed forfeited and costs to remove any belongings will be deducted from the security deposit. A cleaning fee will be deducted from the security deposit if the rental property was left in a state of excess filth or uninhabitable conditions when vacated. 38m. Should circumstances arise that do not allow a tenant to complete the rental agreement term, an Agreement Buyout may be an option. A tenant will provide written notification at least thirty (30) days in advance to the landlord that an Agreement Buyout is desired. The Agreement Buyout is two months' rent ($2000), not including security deposit. If approved by the landlord, an Agreement Buyout is to be paid on the first of the month with the tenant vacating by the end of the same month. The tenant is still responsible for the utilities of the last month. All Agreement Buyouts are at the sole discretion of the landlord. 38n. A tenant may not use or borrow any property, including objects or products, owned by the landlord at any time unless asked for ahead of time and provided permission by the landlord. 38o. A tenant will be provided a mailroom fob, mailbox key upon, and back door patio key at starting of lease. If a tenant does not return both fob and keys in working condition upon end of lease, the tenant will be charged for replacement. 38p. The tenant will have access to the basement utility room, garage utility panel, and main floor thermostat. Nothing will be touched or altered by the tenant(s). The landlord will work with tenant on a sustainable thermostat temperature for both parties or attempt reasonable accommodations. 38q. No illegal, malicious, or questionable activity is allowed. 38r. No smoking or drugs of any kind are allowed in/around the premises. 38s. In case any provision in this agreement shall be invalid, the validity of the remaining terms and conditions shall not be impaired in any way.
