Lease Term The lease term shall be twelve (12) months unless otherwise agreed to in writing by Landlord and Tenant. 2. Security Deposit Tenant shall pay a security deposit equal to one (1) month's rent. The security deposit shall be held and returned in accordance with California law. 3. Rent and Late Charges Rent is due on the date specified in the Lease. Rent shall be paid electronically through Zillow Payments or another payment method approved by Landlord. A late fee of $150 will be charged for rent not paid as provided in the Lease, to the extent permitted by California law. Returned payments may be charged the maximum fee allowed by California law. 4. Utilities Tenant is responsible for payment of: Electricity Natural Gas Internet Cable or streaming services (if desired) Landlord shall pay: Water Trash collection Homeowners Association (HOA) dues 5. Occupancy Maximum occupancy is four (4) persons. Every person residing in the unit, regardless of age, must be listed on the Lease. No unauthorized occupants are permitted. Any person residing in the unit for more than fourteen (14) consecutive days or more than thirty (30) cumulative days during any twelve-month period without Landlord's written approval may constitute a lease violation, subject to California law. 6. Guests Tenant is responsible for the conduct of all guests and invitees. Guests shall comply with all Lease provisions and HOA Rules. 7. Joint and Several Liability If more than one Tenant signs the Lease, each Tenant is jointly and severally liable for all rent, damages, fees, and other obligations under the Lease. 8. HOA Rules and Regulations Tenant acknowledges receiving a copy of the HOA Rules and Regulations before occupancy. Tenant agrees to comply with all current and future HOA Rules and is responsible for ensuring that family members, occupants, and guests comply as well. Any fines, penalties, towing charges, legal expenses, or other costs assessed because of Tenant's or Tenant's guests' actions shall be reimbursed to Landlord within ten (10) days of written notice and shall be considered additional rent. 9. Smoking Smoking or vaping of any substance is prohibited inside the unit, on balconies or patios, and anywhere prohibited by HOA Rules. 10. Pets No pets are permitted without Landlord's prior written approval, except as required by applicable Fair Housing laws regarding assistance animals. 11. Subleasing No subleasing, assignment of the Lease, Airbnb, VRBO, or other short-term rental use is permitted without Landlord's prior written consent. 12. Parking Tenant shall park only in assigned parking spaces or approved street parking. Vehicle repairs, storage of inoperable vehicles, trailers, boats, RVs, or commercial vehicles are prohibited unless specifically permitted by HOA Rules. 13. Move-In Condition Before occupancy, Landlord and Tenant shall complete and sign a Move-In Inspection Checklist. Tenant accepts the Premises in clean, sanitary, and good condition except as noted on the inspection checklist. Photographs and/or video may be used to document the condition of the Premises. 14. Maintenance Responsibilities Tenant agrees to: Keep the Premises clean and sanitary. Replace burned-out light bulbs. Replace HVAC filters, if applicable. Properly operate all appliances. Promptly report plumbing leaks, roof leaks, appliance failures, electrical issues, pest infestations, mold, or any condition that may cause damage. Use bathroom exhaust fans when provided. Prevent mold by promptly removing excess moisture. Keep balconies, patios, and entryways clean and free of prohibited storage. Failure to promptly report maintenance issues resulting in additional damage may make Tenant responsible for those additional repair costs. 15. Plumbing Only human waste and toilet paper may be flushed down toilets. Grease, wipes (including "flushable" wipes), paper towels, diapers, feminine hygiene products, cat litter, and similar materials shall not be disposed of through plumbing fixtures. Tenant is responsible for clearing plumbing blockages caused by misuse. 16. Smoke and Carbon Monoxide Detectors Tenant shall not disable or remove smoke or carbon monoxide detectors and shall promptly notify Landlord if either becomes inoperative. 17. Alterations Tenant shall not paint, install shelving, mount televisions, install satellite dishes, security systems, smart-home devices requiring installation, or make any alterations without Landlord's prior written consent. 18. Keys, Locks, and Access Devices Tenant is responsible for replacement costs of lost keys, mailbox keys, garage remotes, gate remotes, parking permits, or HOA-issued access devices. Tenant shall not change or rekey locks without written permission. If approved, Tenant shall immediately provide Landlord with working keys. Lockout assistance may be provided at Landlord's discretion and may be subject to a reasonable service charge. 19. Pest Control Tenant shall maintain the Premises in a clean condition to discourage pests and promptly report any infestation. Tenant may be responsible for treatment costs if infestation results from Tenant negligence or poor housekeeping. 20. Balconies and Patios Balconies and patios may only contain normal outdoor furniture permitted by HOA Rules. Storage, hanging laundry, open flames, and other prohibited items are not permitted. 21. Waterbeds and Aquariums Waterbeds and aquariums exceeding twenty (20) gallons require Landlord's prior written approval. 22. Renter's Insurance Tenant shall maintain renter's insurance throughout the tenancy with a minimum of $100,000 personal liability coverage and provide proof of insurance before move-in and upon request. 23. Emergency Contact Tenant shall provide Landlord with an emergency contact name and telephone number before occupancy. 24. Illegal Activity Illegal activity on or near the Premises by Tenant or Tenant's guests constitutes a material violation of the Lease. 25. Default Failure to pay rent or comply with any material Lease provision, after any notice required by California law, constitutes a default. 26. Collection Costs and Attorney's Fees Tenant agrees to reimburse Landlord for reasonable collection costs, court costs, and attorney's fees where permitted by California law. In any legal action arising from this Lease, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs to the extent permitted by California law. 27. Mediation Except where immediate legal action is necessary or prohibited by law, the parties agree to attempt mediation before filing suit. 28. Notices Legal notices shall be given in the manner required by California law. Routine communications may also be made by email or text. 29. Waiver Failure of Landlord to enforce any provision shall not constitute a waiver of future enforcement. 30. Survival Tenant's obligations regarding unpaid rent, damages, cleaning charges, HOA fines, attorney's fees, collection costs, and repair costs survive termination of the Lease until satisfied. 31. Severability If any provision of this Addendum is determined to be unenforceable, the remaining provisions shall remain in full force and effect. 32. Entire Agreement This Addendum supplements the Residential Lease Agreement and all applicable HOA Rules and Regulations.
