Tenant agrees that the Landlord shall be entitled to charge for damages not considered normal wear and tear either during the term of the Tenancy, or upon final inspection of the unit at the end of the Tenancy. 8. Tenant agrees to remove their property and debris from the unit and to leave the premises in a neat/clean and broom swept condition at the end of the lease, including the cleaning of all the washrooms and all appliances. 9. In the event that any of the tenant's cheque returns as a NSF (non-sufficient funds), the tenant agrees that he/she shall deliver a certified cheque of the full amount, plus a $50.00 NSF fee, to the landlord or landlord's realtor within 24 hours of being notified. 10. The following chattels belonging to the Landlord are to remain on the premises for the Tenant's use: Fridge, Stove, Dishwasher, Washer & Dryer & electrical light fixtures. 11. The Landlord, at his expense, warrants that all electrical, lighting, plumbing, heating, and fixtures of the premises, and the included chattels shall be in good working order upon commencement of the lease. The Tenant will notify the landlord if any of the appliances are not in good working order within the first TWO [2] weeks and the landlord is responsible for complete repair during this period. 12. The Tenant will use care and consideration in using these appliances, chattels and fixtures provided by the Landlord. Thereafter, the Tenant agrees to pay the FIRST FIVE HUNDRED ($500.000 dollars for any repairs on each occasion, and the landlord shall pay the balance of any repair over this amount, provided that the repairs were required due to normal wear and tear and not required due to the negligence or willful damage by the tenants or guest. 13. The Tenant acknowledges that the Landlord's insurance on the premises does not provide coverage for the Tenant's personal property, or liabilities on behalf of the Tenant. 14. The Tenant shall not do anything on the premises for which the Landlord's insurance premium, if applicable, may be increased. 15. The Tenant shall provide to the Landlord, on or before the commencement of tenancy, a standard tenancy package of insurance policy (Content and Liability Insurance) including sufficient fire, water damage and public liability insurance to cover contents and/or damages to rented premises or others caused by Tenant, his/her family guests through neglect or willful or willful damage. Tenant has to get Rental Insurance of (One)1 million Dollar and this policy one copy has to submit to landlord. 16. Tenant Agrees to make no alterations or decoration changes to the premises without the express written prior consent. In cases where Landlord consents, the Tenant agrees that any alterations will be the Tenant's expense and that the unit will be restored to its original state before vacating. 17. Tenant Agrees to allow the landlord/his Agent, other real estate agents and prospective tenants or purchasers access to the premises during reasonable hours (9AM to 8PM) with 24 hours' notice. 18. The Tenant agrees that the rent payable will increase by 8% and will be in effect on the second year of this lease, in accordance with the guidelines established under the applicable rent review legislation. 19. The Tenant shall keep the leased premise in a smoke-free [cigar/cannabis/cigarette) environment. 20. The Tenant agrees that no locks may be changed or added on any door without the written permission of the Landlord, and the Landlord is to be provided duplicate keys for all locks so install-ed at Tenant's expense within 24 hours of installation of said locks. 22. The Tenant agrees that the landlord or his agent has the right to any occasions during the lease term to inspect the property upon 24 hours' notice of such inspection per year. 23. The landlord and Tenant shall comply with all obligations by the Tenant Protection Act and Amendments, and its regulations. 24. Tenant agrees that the only occupants of the leased premises shall be those persons named on the lease or on the rental application form (no anytime friends or relative allow to stay over night in unit) 25. If either the Tenant or the Landlord wishes to terminate the tenancy at the end of term created by this agreement or any extension or renewal thereof, then either party will give notice to the effect in writing not less than 30 days prior to the expiration of the agreement in compliance with the Landlord and Tenants Act. The Tenant if not in default in payment can renew the lease for a further term mutually agreed by both the Landlord and the Tenant. 26. The Landlord shall not in any event whatsoever be liable or responsible in any way for: A. Any personal injury or death that may be suffered or sustained by the Tenant or any employee or the Tenant or any members of the Tenant's family, his/her guests, or any other person who maybe upon the rented premises or the premises of the Landlord, or B. Any loss of or damage or injury to any property including cars and contents thereof of belonging to the Tenant or any members of the Tenant's family or any person while such property is on the rented premises or on the premises of the Landlord; or Lessee agrees to allow Lessor to show the property to the potential Lessees/Buyers at reasonable hours by giving 24 hours notice to tenant, within the last sixty [60] days prior to expiry of the lease. 27. Tenants shall not sublet or assign the premises. 28. The tenants will clean unit as well as corridor, during the tenancy period of their designated area. 29. The Tenant agrees to pay the cost of all utilities required on the premises during the term of the lease and any extension thereof, including but not limited to, electricity, water, sewer and natural gas or other fuel. The Tenant further agrees to provide proof to the Landlord on or before the date of possession that the services have been transferred to the Tenant's name. 30. The Tenant agrees to be responsible for any repair or replacement cost due to damage from the presence of any pets on the premises. The Tenant further agrees that if pets are kept on the premises, the Tenant shall, at lease termination, at the Tenant's expense, have the carpets professionally cleaned and make any repairs that may be necessary to restore any damages. Also, Landlord not allow any kind of pet inside his property under this lease agreement, if tenant break this condition then landlord will charge $500(five hundred dollar) per month from the day of possession and landlord will give you notice right way to vacant property. 31. The Tenant and any occupants of the premises and, including without limitation, any visitors, guests and business invitees shall not sell, distribute, cultivate, propagate or harvest any cannabis or cannabis plants within the meaning of the Cannabis Act, S.C. 2018 c. 16 and the Cannabis Act, 2017, S.O. 2017, c. 26, as amended from time to time, anywhere in or upon the premises rented by the Tenant, the building where the Tenant's premises are located or in any of the common areas or adjoining grounds of such building. Contravention of this provision shall be deemed to be a material breach of the lease and grounds for termination of the lease. 32. The Tenant and any occupants of the premises and, including without limitation, any visitors, guests, and business invitees shall not smoke anywhere in or upon the (Unit) premises rented by the Tenant, the building where the Tenant's premises are located or in any of the common areas or adjoining grounds of such building, except for the following designated smoking area(s): Visitor parking area only. For purposes of this provision, the term "smoke" or "smoking" means to inhale, exhale, burn or have control over a lighted cigarette, lighted cannabis cigarette, e-cigarette or vaping device, cigar, pipe, hookah pipe or other lighted smoking implement designed to burn tobacco or any other substance, including without limitation, cannabis as defined in the Cannabis Act, S.C.2018 c. 16, as amended from time to time, for the purpose of inhaling or tasting of its emission. Contravention of this provision shall be deemed to be a material breach of the lease and grounds for termination of the lease. 33. The Lease shall contain a clause not permitting the Tenant to assign or sub-lease the demised premises, in whole or part, at any time or times, with consent of the Landlord, and such consent shall not be unreasonably withheld or delayed. Provided that consent as aforesaid shall be required if the Tenant is a corporation and there has been a change of control in the corporation, notwithstanding, the Tenant shall remain on covenant. 34. The Tenant agrees to be responsible for any repair or replacement cost due to damage from the presence of any pets on the premises. The Tenant further agrees that if pets are kept on the premises, the Tenant shall, at lease termination, at the Tenant's expense, have the Units stuff, bed, carpets, professionally cleaned and make any repairs that may be necessary to restore any damages caused by pets.
